Terms of Service
1. General Provisions
1.1. These Terms and Conditions set out the rules for using the online store available at gpjackets.com, as well as the terms for processing orders placed through it.

1.3. The store operates as a distribution platform, providing customers with access to a wide range of products offered by external suppliers, without maintaining its own stock.
1.4. Products offered on the website are shipped directly from the suppliers’ international warehouses to customers. By placing an order, the customer becomes the importer of the goods and is responsible for all customs and tax obligations related to the import, in accordance with applicable laws — unless the supplier participates in the IOSS (Import One Stop Shop) system, in which case VAT is included in the product price.
1.5. Sales made through the store are not subject to VAT in Poland; taxation occurs in the country of origin of the goods, unless the IOSS system applies. Information about VAT handling is displayed clearly on the website before an order is placed (e.g., in the shopping cart).
1.6. The store cooperates with international suppliers and logistics partners to fulfill orders.
1.7. The store reserves the right to restrict product availability for certain countries or customers. Any such restrictions will be communicated prior to placing an order.
2. Order Processing
2.1. The products offered in the store are available through cooperation with international suppliers.
2.2. After the order is placed and full payment is received, the store forwards the order to the relevant supplier, who prepares and ships the product directly to the customer. Orders not paid within 3 business days may be canceled.
2.3. Order processing takes up to 7 business days from the date the payment is received. Delivery time ranges from 4 to 45 business days, depending on the supplier and delivery location.
2.4. The store is not responsible for delays caused by suppliers, logistics providers, customs offices, or incorrect data provided by the customer.
2.5. If delivery does not occur within 45 business days, the customer has the right to withdraw from the contract and receive a refund by notifying tommyecomkontakt@gmail.com in writing within 7 days after that period expires.
3. Product Purchases
3.1. Placing an order constitutes entering into a sales agreement with Tomasz Piłat, under the terms set out in these Terms of Service.
3.2. The store reserves the right to refuse an order in the event of:

technical errors or inaccuracies in product descriptions,

unavailability of the product from the supplier, or

suspected violations of these Terms by the customer.
3.3. Prices listed on the website include VAT only when the supplier uses the IOSS system. Otherwise, prices exclude VAT and customs duties — which remain the responsibility of the customer as the importer. This information is displayed clearly before completing the order.
3.4. The store may change product prices, but such changes will not affect orders that have already been placed and paid for.
4. Store Liability
4.1. The store makes every effort to ensure that product information is accurate and up to date.
4.2. The store is not responsible for changes in product availability after an order has been placed.
4.3. The store is not liable for delays caused by suppliers, logistics companies, or the customer.
4.4. The store is not responsible for the quality of goods supplied by the supplier but assists customers in the complaint process in accordance with applicable law and the General Product Safety Regulation (GPSR).
5. Customer Data and Privacy Policy
5.1. Customers’ personal data are processed solely for the purpose of fulfilling orders and in compliance with the GDPR.
5.2. Data may be shared with suppliers, courier companies, and payment processors. By placing an order, the customer consents to such data sharing.
5.3. Detailed information can be found in the Privacy Policy available on the store’s website.
6. Product Safety (GPSR)
6.1. Products offered in the store comply with GPSR requirements and carry the CE mark where applicable.
6.2. In the event of a detected safety risk, the store will withdraw the product from sale and notify customers about the return or recall procedure.
6.3. Reports should be sent to tommyecomkontakt@gmail.com. Responses are provided within 24 hours.
6.4. Customers are required to follow the manufacturer’s instructions to ensure safe use of the product.
7. Complaints and Returns
7.1. In the event of a product defect, the customer may file a complaint in accordance with the Civil Code (Articles 556–576).
7.2. Complaints must be submitted in writing to tommyecomkontakt@gmail.com within 2 years of delivery.
7.3. The complaint should include the order number, a description of the defect, contact details, and photos (if applicable).
7.4. Complaints are reviewed within 14 business days, or up to 30 days if communication with the supplier is required.
7.5. The consumer has the right to withdraw from the contract within 14 days of receiving the product. Details are available in the Return Policy.
8. Final Provisions
8.1. The store may amend these Terms of Service. The current version is always available on the website.
8.2. Placing an order constitutes acceptance of these Terms of Service.
8.3. Any disputes arising from these Terms will be resolved by the court having jurisdiction over the store’s registered office, unless otherwise required by applicable law.
